Lightning fast adoption of AI has significantly impacted the landscape of trade secrets and data privacy as they relate to intellectual property law. The use of GenAI in workplaces is common now, but gives rise to high risks of disclosure of trade secrets and sensitive information. Adding fuel to the fire is the trend towards adoption of trade secrets instead of patents which may be unintentionally increasing the frequency of inadvertent disclosure.
In this Continuing Legal Education (CLE), we will walk through what in-house counsel need to know, including how AI affects the "readily ascertainable" standard, where data privacy obligations intersect with trade secret law, and what governance measures can meaningfully reduce exposure .
